General Terms and Conditions (GTC)

1. Scope of Application and General Information

These General Terms and Conditions (hereinafter referred to as "GTC") apply to all contracts for the supply of goods concluded by a consumer or entrepreneur (hereinafter referred to as "Customer") with the Seller (hereinafter referred to as "Seller") via this online shop. The inclusion of the Customer's own terms is hereby rejected, unless otherwise agreed.

2. Important Note: Protection of Minors and Minimum Age

The sale of alcohol to children and young people is prohibited by law.

By placing an order in our online shop, the Customer confirms that they have reached the legally prescribed minimum age of 16 years (for wine and sparkling wine) or 18 years (for spirits and spirit-containing beverages).

In order to ensure compliance with the statutory provisions of the Youth Protection Act (JuSchG), an age verification process is carried out as part of the ordering process. Shipping is carried out exclusively via the shipping service DHL using the "Age Verification Check" (Alterssichtprüfung). The goods will only be handed over by the courier to persons who have reached the legally prescribed minimum age. In case of doubt, the courier is entitled to request an official photo ID.

If it turns out that an order was placed by a person not entitled to receive the goods, the contract shall be deemed void. The costs for the unsuccessful shipment shall be borne by the Customer.

3. Conclusion of Contract

The product descriptions contained in the Seller's online shop do not constitute binding offers on the part of the Seller, but serve to submit a binding offer by the Customer.

The Customer can submit the offer via the online shopping cart system integrated into the Seller's online shop. By clicking the button that concludes the ordering process, the Customer submits a legally binding contractual offer in relation to the goods contained in the shopping cart.

The Seller can accept the Customer's offer within two days by sending a written order confirmation (via e-mail) or by delivering the ordered goods.

4. Prices and Payment Terms

The prices stated by the Seller are final prices and include the statutory German Value Added Tax (VAT / MwSt.). Any additional delivery and shipping costs will be specified separately in the respective product description and within the framework of the ordering process.

Various payment options are available to the Customer, which are specified in the Seller's online shop (e.g., credit cards, Shopify Payments, PayPal, depending on activation).

5. Terms of Shipping and Delivery

The delivery of goods is carried out by shipment to the delivery address specified by the Customer within Germany. Shipping is carried out exclusively via DHL with age verification.

If the transport company sends the shipped goods back to the Seller because delivery to the Customer was not possible (or the age verification was negative), the Customer shall bear the costs for the unsuccessful shipment.

6. Retention of Title

If the Seller provides advance performance, the delivered goods remain the property of the Seller until full payment of the purchase price due.

7. Liability for Defects (Warranty)

The statutory liability for defects applies. The Customer is requested to complain immediately to the DHL courier in the event of obvious transport damage (e.g., broken glass) and to notify the Seller.

8. Applicable Law

All legal relationships between the parties shall be governed by the laws of the Federal Republic of Germany, to the exclusion of the laws on the international sale of goods.
